You keep ownership of your work, set your listed prices, and receive 85% of each eligible product sale. SitShakePlay keeps 15% and currently absorbs standard payment-processing costs from its share.
1. Your relationship with SitShakePlay
You are an independent seller, not an employee, agent, franchisee, or partner of SitShakePlay. You control your training methods, product content, business operations, and tax obligations. These terms supplement Stripe’s agreements for your connected account.
2. Product standards and ownership
You retain ownership of your original material and grant SitShakePlay a non-exclusive license to display, market, deliver, and support each listed product while it is offered through the marketplace. You confirm that your material is accurate, humane, legally usable, and does not infringe another person’s copyright, trademark, privacy, publicity, or other rights.
3. Prices and marketplace share
You select the product’s listed price, subject to marketplace price-format and minimum-price rules. For each completed eligible sale, 85% of the listed product price is allocated to your connected Stripe account and 15% is SitShakePlay’s marketplace fee. Required taxes are handled separately when applicable.
4. Refunds, disputes, and reversals
SitShakePlay applies its published Digital Purchase Refund Policy. You authorize SitShakePlay and Stripe to reverse or recover the portion of a payment allocated to you when:
- a refund is approved under the policy;
- a card issuer, payment provider, court, or regulator reverses the transaction;
- the product was not delivered, was materially defective, or materially differed from its listing;
- the transaction was unauthorized or fraudulent; or
- recovery is otherwise required by law or Stripe’s rules.
5. How recovery may occur
You authorize SitShakePlay to reverse the related Stripe transfer, debit an available connected-account balance where permitted, offset the amount against future seller earnings, temporarily hold an appropriate amount from future payouts, or invoice you for an unpaid balance. SitShakePlay will not recover more than the amount reasonably connected to the refund, dispute, chargeback fee, or loss.
6. Evidence and cooperation
You agree to provide accurate product files, descriptions, delivery information, and requested evidence promptly when a buyer reports a problem or disputes a charge. SitShakePlay may submit relevant listing, policy, transaction, delivery-access, and communication records to Stripe or a financial institution.
7. Payout readiness
You must keep your Stripe connected account accurate, verified, and able to receive payouts. SitShakePlay may pause a listing or checkout when Stripe reports incomplete requirements, disabled payouts, elevated risk, or another condition that prevents compliant payment routing.
8. Removal and termination
You may request removal of a product from future sale. Existing buyers retain access rights granted at purchase. SitShakePlay may suspend or remove material that violates these terms, applicable law, Stripe requirements, marketplace safety standards, or another person’s rights. Obligations involving completed sales, refunds, disputes, taxes, and outstanding balances survive removal or termination.
9. Updates
Material changes will be posted with a new version date. Continued listing or sale of products after an updated effective date constitutes acceptance of the revised terms. For questions, contact hello@sitshakeplay.com.
